Statement of Purpose
The proposed 28th Medical Freedom Amendment is the necessary addition to the Bill of Rights within the United States Constitution. The Amendment is the necessary addition of Medical Freedom that Dr. Benjamin Rush, the Nation's first Surgeon General and personal physician to George Washington pursued as he warned that "the time will come when medicine will organize into an undercover dictatorship". He stated that the US Constitution required an amendment securing medical freedom, just as there is the requirement for freedom of speech and religion.
That time of medical dictatorship has grown to the degree that it is now a major disease of society. It must be stopped and an amendment securing medical freedom be enacted. Wealthy lobbying groups, who also have co-opted Agencies of the Executive branch of government, are determining our medical freedom and medical rights. This is a political issue that only we, the citizens, can correct with a massive response. It is our obligation and fulfillment of duty pledged by each citizen for ourselves, families and the future. We are our government governing us. Medical freedom is our inalienable right and must be protected from the tyrannical forces here at home and internationally.
Citizens can never trust its own government. From the earliest days of the Constitution the dangers of greed and self-interest were problems to be solved by separation of powers, courts, and elections. It is the citizen’s obligation and responsibility to make sure that government is honest. It is the citizen's obligation to know their government and to vote in every election. It is the citizen's responsibility to demand the full freedom and rights originally conceived in the writing of the US Constitution. No one could imagine that medicine would develop into that undercover dictatorship that Dr. Benjamin Rush foresaw.
We must secure our freedom, control our destiny, and repel any elitist forces seeking control over our medical decisions and body autonomy. We must be protected from any government action whose agencies are manipulated by corporate economic interests to control medical decisions.
We are in treacherous times that transcends the Rule of Law. Current government legal policies produces immoral and unethical actions. In order to stop and protect our lives the Medical Freedom Amendment requires friend and foe to come together for its passage. This is not a battle between Republicans and Democrats or any other political party. It is a battle between autocratic harmful dictatorship and personal medical freedom of each citizen united to protect individual livelihood and health.
Those opposed to this inalienable right may argue a few reasons why not to have this Amendment. The arguments hinge on bias, ignorance, arrogance, and fear of losing wealth and control. However, there are over 335,000,000 reasons why we must pass this Medical Freedom Amendment. Each of us, every single person, deserves this protection of one's medical freedom and body autonomy.
There is present a list of medical abuse, tyrannical acts, immoral and unethical actions, destruction of competition, inhumane experimentation, bribery, censorship, lying, medical excess deaths and strange defects in human health. This continues to escalate as the government gathers more and more control over medicine and its use as most recently experienced. Wealthy corporate powers and military infringement that ignore individual rights rules the landscape. It is based on corporate law and legal policy powers and not on the Rule of Law.
This dire dictatorship by our elected government officials, government agencies, government departments, and courts is producing the destruction of health of our nation. The government has also agreed and promoted treaties and international agreements that deny medical freedom and promote egregious actions and developments.
We must stop this medical abuse. The first step is enacting medical freedom to protect every person and provide legal and monetary recourse under the Rule of Law and the United States Constitution for those harmed. The longer benefits are thereby demanding government actions to recapture the health and wealth of society by many other necessary reforms. This is work and it must be embraced.

How do you add an Amendment?
There are two ways to propose and ratify amendments to the United States Constitution as defined under Article V. One is two-thirds of both houses of Congress can vote to propose an amendment. Second, two-thirds of the state legislatures can ask Congress to call a national convention to propose the adding of amendments.
To ratify amendments, three-fourths of the state legislatures must approve them. Another option are ratifying conventions in three-fourths of the states must approve them. The Supreme Court has stated ratification must be within "some reasonable time after the proposal."
Starting with the passage of the 18th amendment, Congress set a definite period for ratification. A time period of seven years was established in the case of the 18th, 20th, 21st, and 22nd amendments.
However, there has been no determination as to just how long a "reasonable time" can or should be for passage of a new amendment.

Is it a political problem?
Public Health is not private health. Private health is personal, individual health. It is protected as a Rule of Law governing body autonomy. Every person is unique with different needs and health concerns. When you go to the doctor, you do not want to be treated as a statistic (which never is the truth, only approximations), you want to be treated as an individual, a person. You are also protected by the now established Rule of Law of Informed Consent. That is why the FDA routinely states the use of any medication must include the statement using the advice of your health care provider.
Public health’s job is to protect us from the poisons and toxins placed in our environment by natural events and human activity, especially by businesses that create environment pollution and disease conditions. Large corporations here and abroad control the revolving doors of governmental Agencies and Departments. The environment is impacted by everything from sound, light, spraying, electromagnetic radiation, to medical pharmaceuticals, agricultural modifications of seed genetics, weather modification aerial chemicals, warfare toxins, and wireless exposures. Together they create a perfect storm threatening our livelihood and life on Earth.

Why include details regarding a court warrant?
Warrants can be issued for many things. For example, a Bench Warrant for speeding can be made only for the person speeding, not for everyone driving a car. Making sure the warrant is both specific and individual means no warrant can be made in general or for a group or a community.
The warrant can only be made for an individual and there must be proven danger and cause to the court. This is an important protection from court warrants. If a mandate is issued it cannot be for everyone, only for a specific individual with proven causes of danger and harm.

What about securing freedom and rights from medical intervention?
It was reported that a young girl in Sweden was recently kidnapped by that government for 'affirming' care. There are currently cases in the US where our government has kidnapped children because of medical choices and or procedures about which the child may or may not disagree with their parents. Or the hospital disagrees with the parent's decision which prefers a different treatment not recognized by the standard of care of the hospital. This denial of informed consent and medical freedom is egregious.
The greatest loss of medical rights are usually signed away when people are offered forms and sign them without reading and editing in blue ink any medical form offered to them before signing. Medical interventions occur when people sign their rights over to the hospital or doctor usually unknowingly.
Beware giving away your medical rights! When forms are edited properly, the hospital and staff will treat you differently and respectfully. They do not want to be sued. In the case of parental rights, informed consent requires that the person giving consent not only is fully informed, they are also capable of comprehending the full meaning of any medical procedure, comprehending its ramifications and outcome. Children are not of that age. They come under the sole protection and decision of the parents. This is the case unless a legal warrant meeting all the conditions of the Medical Freedom Amendment requirements to issue a warrant as stated in the second paragraph of the Amendment are met. This necessary protection has recently been denied by the government at all levels - legislative, executive, and judicial and must be corrected and preserved. Can the Amendment be easily changed after being enacted?
No, it is very difficult to change. However, an Amendment can be repealed as in the case of the 18th Amendment of 1919 where the requisite number of states enabled national prohibition. Is the use of right to medical choice and freedom of medical choice redundant?
In legal terms, "rights" and "freedoms" are often used interchangeably, but they do have subtle distinctions. A right is a legally or morally granted entitlement that imposes an obligation on others to either do something or refrain from doing something. It is enforceable by law, and if violated, the law provides remedies or protections. Rights are often specific, and their application involves active duties or prohibitions on the state or other entities.
- Example: The right to a fair trial means the government and courts must ensure you receive a fair judicial process. Right of medical choice means the government, hospitals, doctors must protect your right to informed consent, medical privacy, and body autonomy.

Freedom of medical choice means you are free to choose the medical approach you wish or none at all, subject to legal limits which are specified in the Medical Freedom Amendment.
